DOL Files Complaint Seeking Damages for Whistleblower Fired for Reporting Unsafe Working Conditions

A production operator at a Bridgeton, Missouri plant was fired after reporting unsafe working conditions.

The worker initially reported the unsafe conditions to management, and then reported the conditions to a third party. The next day the employee was suspended, fourteen days later, terminated. 

The worker then filed a complaint with the U.S. Department of Labor’s Occupational Safety and Health Administration. OSHA investigated the complain that alleged the worker was fired in retaliation for reporting unsafe work conditions. On March 9, 2021, OSHA filed a complaint with the U.S. District Court for the Eastern District of Missouri, Eastern Division, alleging the company violated the whistleblower statutes when it terminated the worker. The complaint seeks back wages, reinstatement, damages for the worker, and an order requiring the company to post a notice regarding employees’ rights to report unsafe work conditions without fear of retaliation. 

OSHA’s whistleblower program enforces the twenty plus whistleblower statutes of the Occupational Safety & Health Act. These statutes are designed to protect workers from retaliation when they report unsafe working conditions.
